Who does what in a government procurement?
The procuring entity is the government organization buying goods, infrastructure projects or consulting services. Its end-user unit helps define what is needed. The Bids and Awards Committee (BAC) performs procurement functions under the applicable rules, supported by its secretariat and, where applicable, technical working group.
The supplier or contractor prepares an offer and demonstrates compliance; the authorized government officials make the procurement decisions. PhilGEPS provides official electronic procurement services and notices. GPPB provides procurement policy and rules. These roles are different from an independent discovery tool such as SmartGEPS. See the approved IRR and the guide to PhilGEPS’s role.
Which rules apply: RA 12009 and the transition?
Republic Act No. 12009 is the New Government Procurement Act (NGPA). Its approved IRR took effect on 25 February 2025. GPPB’s Circular 01-2025 states that RA 9184 and its IRR apply to projects whose relevant notice was published before that date. The transition is not a blanket option to choose whichever law is more convenient.
The circular makes the new standard procurement forms mandatory from 21 September 2025 and identifies 15 May 2028 as the full-compliance deadline for the transition. It also addresses continued use of existing guidelines and forms pending corresponding replacements. Apply the relevant issuance and the project’s actual documents rather than combining rules from different periods.
This overview cannot resolve a disputed project’s governing terms. If a notice and its documents appear inconsistent, ask the procuring entity through its formal clarification process. Do not silently substitute the rule you expect.
Separate the procurement category from the method
Goods, infrastructure projects and consulting services have different bidding-document sets. Category affects what the buyer needs to evaluate; method determines how it conducts the procurement. The GPPB document library keeps these categories separate for a reason.
Competitive bidding follows a structured competitive process. Other methods address their own circumstances and conditions. An RFQ is a Request for Quotation, not a universal statement of one method or a fixed peso limit. The IRR uses quotation requests in more than one procedure.
Read the notice’s method field, the solicitation and its instructions together. An official RFQ example can help you recognize the format, but its requirements and dates belong only to that procurement. Avoid applying a threshold copied from an old article to a different method or period.
Read the practical Request for Quotation guide and Invitation to Bid guide for the questions a supplier should check in each document.
Understand the lifecycle before you quote a price
- Planning: the government organization identifies the requirement, budget and procurement approach.
- Solicitation: the opportunity and documents explain the scope and participation procedure.
- Submission and evaluation: offers are received and assessed through the applicable process.
- Verification and award: the selected offer must satisfy the required checks before the relevant award decision.
- Contract implementation: signing, applicable security and commencement requirements lead into delivery or execution, inspection and other contract obligations.
This is an orientation map, not a statutory timetable. For an actionable competitive-bid preparation process, use How to Bid in PhilGEPS. The goods bidding documents show why award, contract and Notice to Proceed should not be treated as the same event.
A short guide to procurement documents
- Bidding documents
- The project package describing requirements, instructions, forms, evaluation and contract terms. The notice alone is not the whole package.
- BDS
- Bid Data Sheet: project-specific information that must be read with the Instructions to Bidders.
- ABC
- Approved Budget for the Contract. Check project and lot treatment. A budget is not the value of an automatic award.
- Omnibus Sworn Statement
- A prescribed set of bidder declarations. Correct information, authority and execution matter; it is not the PhilGEPS membership declaration.
- Bid security
- An applicable bidding-stage requirement whose permitted form and conditions must be checked in the procurement documents.
- NOA / NTP
- Notice of Award / Notice to Proceed. They serve different stages; read each notice and the contract before acting.
Consult the official standard forms for the correct form family. Some forms on that page are explicitly limited to particular procurement methods; similar titles do not make them interchangeable.
What a supplier should organize before chasing volume
Build three small working files. First, maintain current company and PhilGEPS registration records. Second, keep capability evidence your team can readily verify. Third, keep a realistic costing and delivery worksheet that accounts for the actual scope.
Give someone ownership of each deadline and unresolved question. For example, a distributor may need supplier lead-time confirmation while a contractor needs a technical review of the scope. Neither problem is solved merely by finding more notices.
These are practical business controls, not additional government requirements. They help you decide which opportunities merit effort before you incur document-acquisition or preparation costs.
Make discovery support the procurement work
Start with a manageable PhilGEPS opportunity shortlist. SmartGEPS can help filter and organize that search, with reporting and preparation features described on the product page.
Official eligibility decisions, bid submission and award remain with the applicable government process. SmartGEPS is not PhilGEPS, PS-DBM, GPPB or a government agency, and does not offer government endorsement or guaranteed contract results.
